These Terms and Conditions (the "Agreement") govern your participation in Thrive Academy for Overeating (the "Program"), a monthly membership coaching program offered by Dr. Siobhan Key Inc. (the "Provider"). By enrolling in the Program, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
1. Services and Fees
The Program is a monthly membership offered on a subscription basis. The monthly membership fee is set out on the Provider's website and sales page at the time of enrollment and is subject to change with reasonable notice. Applicable taxes (including GST/HST for Canadian members) will be added to the membership fee at checkout.
The Program is operated by Dr. Siobhan Key Inc., a company incorporated in British Columbia, Canada. It is available to members worldwide. Members are responsible for ensuring that their participation complies with any applicable laws or regulations in their own jurisdiction.
Your monthly membership includes access to the following components as they are scheduled and made available:
- Monthly live group workshop
- Monthly live Q&A session
- Two live group coaching calls per month (the "Bring Me Anything Call" and the "Momentum Call")
- On-demand content library
- Private Success Path Podcast
- SOS VideoAsk support tool
The Provider reserves the right to adjust, update, or substitute Program components from time to time. Any material changes to Program content will be communicated to members in advance.
2. Nature of the Program — Not Medical Care
Thrive Academy for Overeating is a coaching and education program focused on behavioural modification, mindset, and self-coaching skills as they relate to overeating and emotional eating. It is NOT a medical program and does NOT constitute medical care, medical advice, diagnosis, or treatment.
Participation in the Program does not create a doctor-patient relationship between you and the Provider, regardless of the Provider's credentials as a physician. The Program focuses exclusively on non-medical tools including behavioural coaching, mindset strategies, and evidence-informed educational content.
You are responsible for your own physical, mental, and emotional well-being. If you have a medical condition, eating disorder, or mental health concern, you are strongly encouraged to seek appropriate care from a qualified healthcare professional. The Program is not a substitute for such care.
The Provider is unable to offer personal medical advice, diagnose conditions, or prescribe or recommend medications as part of this Program.
3. Live Sessions — Scheduling and Access
All live sessions (workshops, Q&A sessions, and coaching calls) are scheduled at the sole discretion of the Provider. Session schedules will be communicated to members in advance, but the Provider does not guarantee that session times will accommodate all members' individual schedules. No refund or credit will be issued on the basis of scheduling conflicts.
All live sessions will be recorded. Recordings will be posted in the Program's online portal within a reasonable time following each session and will remain accessible to active members for the duration of their membership.
By enrolling in the Program and participating in any live session, you consent to the recording of those sessions for the purposes of sharing with all current Program members through the online portal.
4. Group Coaching Calls — Participation Policy
The live group coaching calls included in this Program are group sessions. The Provider does not guarantee that every member will receive individual coaching or be coached directly during any given call.
Coaching during group calls will be offered on a first-come, first-served basis. Priority will be given to members who have not received individual coaching on a recent call, in order to serve as many members as possible over time.
Members who are not coached directly in a session are encouraged to attend and benefit from the coaching provided to other participants, as the insights shared are frequently applicable across the group.
5. Electronic Communications
Live sessions are conducted via videoconferencing technology ("Electronic Communication"). While the Provider will use reasonable means to protect the security and confidentiality of session content, the Provider cannot guarantee the security of Electronic Communications. Participation via Electronic Communication carries inherent risks, including the possibility of information being disclosed to third parties. You assume these risks by participating.
6. Community Standards
Thrive Academy for Overeating is a community built on mutual respect, safety, and inclusion. All members are expected to engage with the Provider, Program staff, and fellow members in a manner that is respectful, kind, and constructive at all times.
The following behaviours are not permitted within any Program space, including live sessions, community forums, or any associated communication channels:
- Bullying, harassment, intimidation, or personal attacks of any kind;
- Racism, discrimination, or derogatory language or conduct directed at any person on the basis of race, ethnicity, national origin, religion, gender, sexual orientation, disability, body size, or any other characteristic;
- Sharing, distributing, or promoting diet culture content, weight stigma, or content that could be harmful to members' relationships with food or their bodies;
- Any other conduct that, in the Provider's sole judgment, is disruptive, harmful, or inconsistent with the values and safety of the community.
The Provider reserves the right to remove any member from the Program immediately and without refund if these standards are violated. This includes removal from all live sessions, community spaces, and the online portal.
7. Confidentiality
All information shared by members during live group sessions is to be treated as confidential by all participants. By enrolling in the Program, you agree to maintain the confidentiality of other members' personal information and anything shared within the Program's community spaces.
This confidentiality obligation does not apply where disclosure is required by law or where there is an imminent risk of harm to a group member or another person.
8. Intellectual Property and Content Use
All content provided through the Program — including workshop recordings, session recordings, on-demand materials, the private podcast, and any written or video resources — is the intellectual property of Dr. Siobhan Key Inc. and is protected by copyright.
Your membership provides you with an individual, non-transferable licence to access Program content for your personal use only. You may not share, reproduce, distribute, resell, or repurpose any Program content — including via social media platforms, email, or any other medium — without the prior written consent of the Provider.
9. Membership Cancellation and Refund Policy
You may cancel your membership at any time. Cancellation takes effect at the end of the current billing period; you will retain access to the Program through the date your membership expires. No partial refunds will be issued for unused days within a billing period.
If you actively participate in the Program and find it is not right for you within the first thirty (30) days of your initial enrollment, you may request a full refund of your first month's membership fee by emailing the Provider. Refund requests made after thirty (30) days from your initial enrollment date will not be honoured. The Provider reserves the right to verify participation before processing any refund. This refund policy applies to your initial enrollment only and does not apply to subsequent billing periods.
The Provider reserves the right to revoke a member's access at any time, for any reason, including violations of these Terms and Conditions or conduct that disrupts the experience of other members.
10. No Guarantee of Results
The Provider makes no representations, warranties, or guarantees regarding specific outcomes, results, or changes in behaviour, weight, or health as a result of participating in the Program. Individual results will vary. Your results depend on your engagement, consistency, and a variety of personal factors outside the Provider's control.
11. Limitation of Liability
To the maximum extent permitted by applicable law, the Provider is not liable for any direct, indirect, incidental, or consequential loss or damage arising from your participation in the Program or your use of Program materials. You participate voluntarily and assume full responsibility for your actions and their outcomes.
12. Governing Law
This Agreement is governed by and construed in accordance with the laws of the Province of British Columbia and the applicable federal laws of Canada. Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.
13. Agreement
By enrolling in Thrive Academy for Overeating, you confirm that:
- You have read and understood these Terms and Conditions;
- You voluntarily agree to participate in the Program under the terms set out above;
- You understand that this is a coaching and education program and does not constitute medical care; and
- You are 18 years of age or older.
